Most Cases Don't Require Planning Permit for a Granny Flat

  • The Victorian government has recently introduced reforms that remove the requirement for a planning permit to build a granny flat (also called a "small second home" or "dwelling garden unit") under 60 square metres.

  • This exemption applies to properties larger than 300 square metres that are not subject to specific environmental or flooding overlays.

Building Permits Are Still Required for a Granny Flat below

  • While a planning permit is no longer needed in most cases, a building permit is still required to ensure the granny flat meets all relevant building codes and safety standards.
  • The building permit process involves having the granny flat plans certified by either a private certifier or the local council.

 Other Requirements for a Granny Flat Still Apply

  • Even without a planning permit, granny flats must still meet setback, siting, and other design requirements set out in the residential design code.
  • There may also be restrictions from the local council or existing covenants on the property that need to be considered.

So in summary, the key change is that a planning permit is no longer required to build a granny flat under 60 square metres on eligible properties in Victoria. However, a building permit is still mandatory, and other regulatory requirements must be met
